Architectural Review Committee - The Architectural Review Committee (ARC) is Responsible for all matters that involve the exterior appearance of the community, including house exteriors, walls, fences, driveways, mailboxes, docks, and other items.
Exterior Property Alterations - It is great to see many of our neighbors fixing up their property - painting, new roofs, new fences, windows & doors, landscaping.... But many of our new residents are unaware of the Home Owners Association (HOA) Rules and Regulations relating to exterior alterations. The rules state that all residents planning to make exterior alterations to their property must obtain prior written approval from the governing HOA Board Architectural Committee. Alternations include, but are not limited to:
> Additions to the house structure or adding any structure to the property (shed, gazebo, pool, playhouse)
> Painting of house, wall or fence
> Replacement or alteration of fence, boarder shrubs, wall, gates, roof or mailbox
> Replacing or altering driveway, walks or patio (called 'Hardscape' by the City Building Dept)
> Adding or removing windows, doors or hurricane shutters
> Adding or modifying a boat dock, including those located on Common Ground
> The removal or addition of any tree or large shrubbery.
The above (with the exception of painting) require the homeowner to obtain a permit from the City of Delray, and the City Building Department will ask the homeowner for proof from the Rainberry Villas HOA granting approval for the 'alteration'. Warning: If the homeowner does not obtain a City permit, and the Code Enforcement Officer is in the neighborhood (he is frequently in our neighborhood), he will issue a 'stop-work-order', impose a fine and delay the work completion - often for months.
In addition, many of these types of alterations involve digging that may impact the sprinkler system. Modifications to and repairs for damages to the sprinkler system will be charged back to the homeowner. The sprinkler system is owned by the HOA and only the HOA contractor is permitted to perform and work on the system.
Only Licensed and Insured Contractors are permitted to perform Property Alterations. The HOA will require your contractor to submit proof of their license and insurance and will require that the contractor name The Villas of Rainberry as also insured. In addition, contractors will be provided with instructions governing working hours, vehicles and equipment, trash cleanup, etc.
Mail Boxes - All mailboxes in Rainberry Villas must conform in size and shape (look around the neighborhood at others), and must be a single color - white, brown or beige. The style must be that of a simple, standard rural mailbox (no oversize package boxes), and shape must be the typical simple container with a door on the street side and a flag. The mailbox will be mounted on a 4x4 pressure-treated wood post. Decorative boxes or boxes depicting animals, birds or other shapes are not permitted. If in doubt, send a picture of the proposed mailbox to the Architectural Committee before purchasing the box.
